CONDITIONS GENERALES DE VENTE (FR)
Les présentes Conditions Générales de Vente sont conclues d’une part par la société Agathe Leroy au capital social de 0€ dont le siège social est situé a 8 rue Calmels 75018 Paris, France, immatriculée au Registre du Commerce et des Sociétés de Paris sous le numéro ci-dessous 901664573RM75 après dénommée “Agathe Leroy” et gérant le site www.agatheleroy.com et, d’autre part, par toute personne physique ou morale souhaitant procéder à un achat via le site internet www.agatheleroy.com dénommée ci-après ” l’acheteur “.
Article 1. Objet
Les présentes conditions de vente visent à définir les relations contractuelles entre Agathe Leroy et l’acheteur et les conditions applicables à tout achat effectué par le biais du site internet www.agatheleroy.com. L’acquisition d’un produit à travers le présent site implique une acceptation sans réserve par l’acheteur des présentes conditions de vente dont l’acheteur reconnaît avoir pris connaissance préalablement à sa commande. Avant toute transaction, l’acheteur déclare d’une part que l’achat de produits sur le site www.agatheleroy.com est sans rapport direct avec son activité professionnelle et est limité à une utilisation strictement personnelle et d’autre part avoir la pleine capacité juridique, lui permettant de s’engager au titre des présentes conditions générales de ventes.
La société Agathe Leroy conserve la possibilité de modifier à tout moment ces conditions de ventes, afin de respecter toute nouvelle réglementation ou dans le but d’améliorer l’utilisation de son site. De ce fait, les conditions applicables seront celles en vigueur à la date de la commande par l’acheteur.
Article 2. Produits
Les produits proposés sont ceux qui figurent sur le site www.agatheleroy.com de la société Agathe Leroy, dans la limite des stocks disponibles. La société Agathe Leroy se réserve le droit de modifier à tout moment l’assortiment de produits. Chaque produit est présenté sur le site internet sous forme d’un descriptif reprenant ses principales caractéristiques techniques (couleur, taille, composition). Les photographies sont les plus fidèles possibles mais n’engagent en rien le Vendeur. La vente des produits présentés dans le site www.agatheleroy.com est destinée à tous les acheteurs résidants dans les pays qui autorisent pleinement l’entrée sur leur territoire de ces produits. (Hors Russie, Finlande).
Article 3. Prix
Les prix des produits sont indiqués en Euros (€) toutes taxes comprises (TTC) et hors frais de douanes pour les commandes hors UE qui restent a la charge du client.
Tout changement du taux de la TVA pourra être répercuté sur le prix des produits.
La société Agathe Leroy se réserve le droit de modifier ses prix à tout moment, étant toutefois entendu que le prix figurant au catalogue le jour de la commande sera le seul applicable à l’acheteur. Les prix indiqués ne comprennent pas les frais de livraison, facturés en supplément du prix des produits achetés suivant le montant total de la commande. Depuis la France métropolitaine, les frais d’expédition seront facturés à l’acheteur d’un montant de 10€ pour un envoi vers la France, 15€ vers l’Europe, 25€ pour les livraisons vers l’international (USA).
Article 4. Commande et modalités de paiement
La société Agathe Leroy propose à l’acheteur de commander et régler ses produits en plusieurs étapes, avec 2 options de paiement au choix :
– Paiement par carte bancaire : l’acheteur sélectionne les produits qu’il souhaite commander dans le « panier », modifie si besoin (quantités, références…), vérifie l’adresse de livraison ou en renseigne une nouvelle. Puis, les frais de port sont calculés et soumis à l’acheteur, ainsi que le nom du transporteur. Ensuite, l’acheteur choisit le mode de paiement de son choix : « Paiement par carte ». Enfin, la dernière étape lui propose de vérifier l’ensemble des informations, prendre connaissance et accepter les présentes conditions générales de vente en cochant la case correspondante, puis l’invite à valider sa commande en cliquant sur le bouton « Confirmer ma commande ». Ce dernier clic forme la conclusion définitive du contrat. Dès validation, l’acheteur reçoit un bon de commande confirmant l’enregistrement de sa commande. Dès réception du paiement, la commande sera traitée et l’acheteur en sera informé par e-mail.
– Paiement sécurisé par Paypal (via le système PAYPAL) : l’acheteur sélectionne les produits qu’il souhaite commander dans le « panier », modifie si besoin (quantités, références), vérifie l’adresse de livraison ou en renseigne une nouvelle. Puis, les frais de port sont calculés et soumis à l’acheteur, ainsi que le nom du transporteur. Ensuite, l’acheteur choisit le mode de paiement de son choix : « Paiement par Paypal ». L’étape suivante lui propose de vérifier l’ensemble des informations, prendre connaissance et accepter les présentes conditions générales de vente en cochant la case correspondante, puis l’invite à valider sa commande en cliquant sur le bouton « Confirmer ma commande ». Enfin, l’acheteur est redirigé sur l’interface sécurisée PAYPAL afin de renseigner en toute sécurité ses références de compte Paypal. Si le paiement est accepté, la commande est enregistrée et le contrat définitivement formé.
La confirmation d’une commande entraîne acceptation des présentes conditions de vente, la reconnaissance d’en avoir parfaite connaissance et la renonciation à se prévaloir de ses propres conditions d’achat. L’ensemble des données fournies et la confirmation enregistrée vaudront preuve de la transaction. Si l’acheteur possède une adresse électronique et s’il l’a renseignée sur son bon de commande, la société Agathe Leroy lui communiquera par courrier électronique la confirmation de l’enregistrement de sa commande.

Article 5. Réserve de propriété
La société Agathe Leroy conserve la propriété pleine et entière des produits vendus jusqu’au parfait encaissement du prix, en principal, frais et taxes compris.
Article 6. Rétractation
En vertu de l’article L121-20 du Code de la consommation, l’acheteur dispose d’un délai de 14 jours ouvrables à compter de la livraison de leur commande pour exercer son droit de rétractation et ainsi faire retour du produit au vendeur pour échange ou remboursement sans pénalité, à l’exception des frais de retour.
Pour tout retour, l’Acheteur devra contacter le service client par email : hi@agatheleroy.com pour l’informer de sa volonté d’user de son droit de rétractation. Tout colis renvoyé au delà des délais annoncés, sera refusé et renvoyé à son expéditeur. Les frais et risques liés au retour des produits sont à la charge de l’expéditeur.
Pour que le service client accepte l’échange et/ou le remboursement, le Produit devra être renvoyé complet dans son emballage d’origine, non endommagé, avec son étiquette accrochée, ni porté, accompagné de tous ses accessoires et d’une copie de la facture d’achat à Agathe Leroy – 8 rue Calmels 75018 Paris, France.
L’Acheteur n’aura pas à justifier de motifs ni à payer de pénalités, à l’exception des frais de retour. Agathe Leroy ne sera pas tenue responsable en cas de perte, vol ou dommage du colis. Les colis pour lesquels l’identification de l’Acheteur (nom, prénom, adresse) ne sera pas possible, seront refusés.
Tout retour doit se faire par une méthode traçable (UPS, Fedex, DHL, La Poste,…) et le numéro de suivi doit être communiqué à Agathe Leroy. A réception du produit par Agathe Leroy, le service client adressera par e-mail une confirmation de réception du produit.
Article 7. Livraison
Les livraisons sont faites à l’adresse indiquée sur le bon de commande qui ne peut être que dans la zone géographique convenue. Les commandes sont effectuées par La Poste, service de livraison avec suivi, remise sans signature.
Les délais de livraison ne sont donnés qu’à titre indicatif ; si ceux-ci dépassent 50 jours à compter de la commande, le contrat de vente pourra être résilié et l’acheteur remboursé. Il devra s’adresser au service client par e-mail : hi@agatheleroy.com.
La société Agathe Leroy pourra fournir par e-mail à l’acheteur le numéro de suivi de son colis. L’acheteur est livré à son domicile par son facteur. En cas d’absence de l’Acheteur, il recevra un avis de passage de son facteur, ce qui lui permet de retirer les produits commandés au bureau de Poste le plus proche, pendant un délai indiqué par les services postaux. Dans l’hypothèse d’une impossibilité de livraison et si le produit était alors retourné à Agathe Leroy par le transporteur, Agathe Leroy effectuera un second envoi aux frais de l’Acheteur.
Les risques liés au transport sont à la charge de l’Acheteur à compter du moment où les articles quittent les locaux de la société Agathe Leroy.
L’acheteur est tenu de vérifier en présence du préposé de La Poste ou du livreur, l’état de l’emballage de la marchandise et son contenu à la livraison. En cas de dommage pendant le transport, toute protestation doit être effectuée auprès du transporteur et de Agathe Leroy au moment même de la livraison.
Le délai moyen constaté entre le passage d’une commande et sa livraison est de 10 jours ouvrés. Il s’agit d’un délai moyen constaté.
Agathe Leroy ne saurait être tenue responsable pour toute action et/ou frais et/ou taxes (qui révèlent de la responsabilité de l’Acheteur) et/ou retards dus aux services des douanes et des transporteurs sur lesquels elle n’a aucun contrôle.
Si la commande comporte plusieurs articles, Agathe Leroy pourra les adresser à l’Acheteur en plusieurs livraisons et/ou paquets.
Toute réclamation concernant la livraison des Produits doit être formulée au plus tard 14 jours après la réception du ou des articles dans les mêmes conditions que ci-dessus mentionné. S’il est décidé que le(s) produit(s) doivent être renvoyé(s) à Agathe Leroy, ils devront être retournés dans leur état d’origine (emballage, accessoires…) et selon les conditions d’expédition suivantes.
Le Client devra préalablement contacter le service client via le mail: hi@agatheleroy.com afin de lui formuler la volonté de procéder à un retour ou échange. Le Produit devra être renvoyé à Agathe Leroy – 8 rue Calmels, 75018 Paris, France.
Article 8. Garantie
Les Produits vendus par Agathe Leroy sont soumis aux conditions de garanties légales prévues par les articles L.217-4 à L.217-14 du Code de la Consommation ainsi que par les articles 1641 à 1648 du Code Civil, à l’exclusion de toutes autres garanties :
Agathe Leroy refusera toute réclamation portant sur des Produits qui ont été utilisés de façon inappropriée, si l’étiquette est manquante ou si le vêtement a été endommagé.
Toute réclamation concernant les Produits en tant que tels et sans liens avec la livraison doit être formulée par email à l’adresse hi@agatheleroy.com.
Article 9. Responsabilité
La responsabilité de la société Agathe Leroy dans le processus de vente à distance ne pourra être engagée pour un dommage résultant de l’utilisation du réseau Internet tel que perte de données, intrusion, virus, rupture du service, ou autres problèmes involontaires.
Article 10. Propriété intellectuelle
Tous les éléments du site www.agatheleroy.com sont et restent la propriété intellectuelle et exclusive de la société Agathe Leroy. Personne n’est autorisé à reproduire, exploiter, ou utiliser à quelque titre que ce soit, même partiellement, des éléments du site qu’ils soient sous forme de photo, logo, visuel ou texte.
Article 11. Données personnelles
La société Agathe Leroy s’engage à préserver la confidentialité des informations fournies par l’acheteur, qu’il serait amené à transmettre pour l’utilisation de certains services. Toute information le concernant est soumise aux dispositions de la loi n° 78-17 du 6 janvier 1978. A ce titre, l’internaute dispose d’un droit d’accès, de modification et de suppression des informations le concernant. Article 12. Règlement des litiges
Les présentes Conditions Générales de Vente à distance sont soumises à la loi française.
En cas de litige les tribunaux français seront seuls compétents. Toutefois, en application du Règlement CE 593/2008 du 17 juin 2008, les présentes CGV ne font pas obstacles à l’application d’une disposition plus favorable au Client, à laquelle il ne peut être dérogé par accord, et ce en vertu de la loi du pays où le Client a sa résidence habituelle.

The present General Conditions of Sale are concluded on the one hand by the company Agathe Leroy with a capital of 0€ whose head office is located at 8 rue Calmels 75018 Paris, France, registered with the Register of Commerce and Companies of Paris under the number 901664573RM75 hereafter called “Agathe Leroy” and managing the website www.agatheleroy.com and, on the other hand, by any individual or legal entity wishing to proceed to a purchase via the website www.agatheleroy.com hereafter called “the buyer”.
Article 1. Object
The present conditions of sale aim at defining the contractual relations between Agathe Leroy and the purchaser and the conditions applicable to any purchase carried out by the means of the Internet site www.agatheleroy.com. The acquisition of a product through the present site implies an acceptance without reserve by the purchaser of the present conditions of sale of which the purchaser recognizes to have taken knowledge before his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.agatheleroy.com is without direct relationship with his professional activity and is limited to a strictly personal use and on the other hand to have the full legal capacity, allowing him to engage under the present general conditions of sales.
The company Agathe Leroy keeps the possibility of modifying at any time these conditions of sales, in order to respect any new regulation or in order to improve the use of its site. Therefore, the applicable conditions will be those in force at the date of the order by the buyer.
Article 2. Products
The offered products are those which appear on the site www.agatheleroy.com of the company Agathe Leroy, within the limit of available stocks. The company Agathe Leroy reserves the right to modify at any time the assortment of products. Each product is presented on the website in the form of a description of its main technical characteristics (color, size, composition). The photographs are as accurate as possible but do not commit the Seller. The sale of the products presented on the site www.agatheleroy.com is intended for all buyers residing in countries that fully authorize the entry of these products into their territory. (Except Russia, Finland).
Article 3. Prices
The prices of the products are indicated in Euros (€) including all taxes (TTC) and excluding customs charges for orders outside the EU which remain the responsibility of the customer.
Any change of the VAT rate could be reflected on the price of the products.
The company Agathe Leroy reserves the right to modify its prices at any time, being however understood that the price appearing in the catalog the day of the order will be the only applicable one to the purchaser. The prices indicated do not include the delivery charges, invoiced in addition to the price of the products purchased according to the total amount of the order. From metropolitan France, shipping costs will be charged to the buyer in the amount of 10€ for a shipment to France, 15€ to Europe, 25€ for international deliveries (USA).
Article 4. Order and payment terms
The company Agathe Leroy proposes to the buyer to order and pay his products in several steps, with 2 payment options to choose from:
– Payment by credit card: the buyer selects the products he wishes to order in the “basket”, modifies if necessary (quantities, references…), checks the delivery address or informs a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: “Payment by card”. Finally, the last step proposes to him to check all the information, to take knowledge and to accept the present general conditions of sale by notching the corresponding box, then invites him to validate his order by clicking on the button “Confirm my order”. This last click constitutes the final conclusion of the contract. Upon validation, the buyer receives an order form confirming the registration of his order. Upon receipt of payment, the order will be processed and the buyer will be informed by e-mail.
– Secure payment by Paypal (via the PAYPAL system): the buyer selects the products he/she wishes to order in the “basket”, modifies if necessary (quantities, references), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice: “Payment by Paypal”. The next step proposes to verify all the information, to read and accept the present general conditions of sale by checking the corresponding box, then invites him to validate his order by clicking on the corresponding box, then invites him to validate his order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the PAYPAL secure interface in order to safely enter his Paypal account information. If the payment is accepted, the order is recorded and the contract is definitively formed.
The confirmation of an order implies acceptance of these terms and conditions of sale, the recognition of having perfect knowledge of them and the waiver of its own conditions of purchase. All the data provided and the recorded confirmation will be worth proof of the transaction. If the buyer has an e-mail address and if he/she has given it on the order form, the company Agathe Leroy will send him/her an e-mail confirming the registration of his/her order.

Article 5. Reserve of property
The company Agathe Leroy preserves the full and whole property of the sold products until the perfect collection of the price, in principal, expenses and taxes included.
Article 6. Withdrawal
In accordance with the article L121-20 of the Code of consumption, the purchaser has a 14 working days deadline as from the delivery of their order to exert his right of retractation and thus to make return of the product to the salesman for exchange or refunding without penalty, except for the expenses of return.
For any return, the Buyer will have to contact the customer service by email: hi@agatheleroy.com to inform him of his will to use his right of retractation. Any parcel returned after the announced deadlines, will be refused and sent back to its sender. The expenses and risks related to the return of the products are the responsibility of the sender.
For the customer service to accept the exchange and/or the refund, the Product will have to be sent back complete in its original packaging, not damaged, with its label attached, nor worn, accompanied by all its accessories and a copy of the purchase invoice to Agathe Leroy – 8 rue Calmels 75018 Paris, France.
The Buyer will not have to justify any reasons nor to pay any penalties, except for the return shipping costs. Agathe Leroy will not be held responsible in case of loss, theft or damage of the package. The parcels for which the identification of the Buyer (name, first name, address) will not be possible, will be refused.
All returns must be made by a traceable method (UPS, Fedex, DHL, La Poste,…) and the tracking number must be communicated to Agathe Leroy. Upon receipt of the product by Agathe Leroy, the customer service will send a confirmation of receipt of the product by e-mail.
Article 7. Delivery
The deliveries are made to the address indicated on the order form which can be only in the agreed geographical zone. The orders are made by La Poste, delivery service with follow-up, delivery without signature.
Delivery times are given as an indication only; if they exceed 50 days from the order, the sales contract may be terminated and the buyer reimbursed. He will have to contact the customer service by e-mail: hi@agatheleroy.com.
The company Agathe Leroy will be able to provide by e-mail to the purchaser the number of follow-up of his parcel. The buyer is delivered at his home by his letter carrier. In case of absence of the Buyer, he will receive a notice of passage of his factor, which allows him to withdraw the ordered products to the nearest post office, during a time indicated by the postal services. In the event of an impossibility of delivery and if the product was then returned to Agathe Leroy by the carrier, Agathe Leroy will carry out a second sending at the expenses of the Purchaser.
The risks related to the transport are the responsibility of the Buyer as from the moment when the articles leave the premises of the company Agathe Leroy.
The Buyer is required to verify in the presence of the employee of the Post Office or the deliveryman, the state of the packaging of the goods and its contents at the delivery. In case of damage during transport, any protest must be made to the carrier and Agathe Leroy at the time of delivery.
The average time between the placing of an order and its delivery is 10 working days. It is an average time noted.
Agathe Leroy cannot be held responsible for any action and/or fees and/or taxes (which are the responsibility of the Buyer) and/or delays due to customs services and carriers over which it has no control.
If the order includes several items, Agathe Leroy may send them to the Buyer in several deliveries and/or packages.
Any complaint concerning the delivery of the Products must be formulated at the latest 14 days after the reception of the article(s) under the same conditions as mentioned above. If it is decided that the product(s) must be returned to Agathe Leroy, they must be returned in their original condition (packaging, accessories…) and according to the following shipping conditions.
The Customer will have to contact the customer service via the e-mail: hi@agatheleroy.com in order to formulate the will to proceed to a return or exchange. The Product must be returned to Agathe Leroy – 8 rue Calmels, 75018 Paris, France.
Article 8. Guarantee
The Products sold by Agathe Leroy are subject to the conditions of legal guarantees provided by articles L.217-4 to L.217-14 of the Consumer Code as well as by articles 1641 to 1648 of the Civil Code, to the exclusion of all other guarantees:
Agathe Leroy will refuse any claim concerning Products that have been used inappropriately, if the label is missing or if the garment has been damaged.
Any claim concerning the Products as such and not related to the delivery must be made by email to hi@agatheleroy.com.
Article 9. Responsibility
The responsibility of the company Agathe Leroy in the process of remote sale could not be committed for a damage resulting from the use of the Internet network such as loss of data, intrusion, virus, rupture of the service, or other involuntary problems.
Article 10. Intellectual property
All the elements of the site www.agatheleroy.com are and remain the intellectual and exclusive property of the company Agathe Leroy. Nobody is authorized to reproduce, to exploit, or to use with some title that it is, even partially, of the elements of the site that they are in the form of photograph, logo, visual or text.
Article 11. Personal data
The company Agathe Leroy commits itself to preserve the confidentiality of the information provided by the buyer, which he would be brought to transmit for the use of certain services. Any information concerning him is subjected to the provisions of the law n° 78-17 of January 6, 1978. As such, the Internet user has a right to access, modify and delete information concerning him. He can make the request at any time by mail at the following address Agathe Leroy – 8 rue Calmels 75018 Paris, France.
Article 12. Settlement of disputes
The present General Conditions of Sale are subject to French law.
In case of dispute, the French courts will have exclusive jurisdiction. However, in application of the EC Regulation 593/2008 of June 17, 2008, the present General Terms and Conditions of Sale do not prevent the application of a provision more favorable to the Customer, which cannot be derogated from by agreement, and this by virtue of the law of the country where the Customer has his usual residence.
